Capital Gains Tax on Shares on off market deals

    If I buy and sell a share of a private limited company in an off market deal, which obviously is not listed on exchange. What will be the tax treatment for long term or short term capital gains tax.

    In case the shares are not not listed then these are taxable because in case the shares are sold through stock exchange or on which Security Transanction Tax (STT) is paid and the shares are sold after one year then these are exempt.Otherwise these are taxable as short term or long term capital gain depending upon the period of holding such as if the holding period is less than a year then these taxable under short term capital gain otherwise long term capital gain and are taxed accordingly.
