Company has taken Group Mediclaim Insurance for its employees say from National Insurance Company Limited and paying 100% insurance premium directly to the insurance company. 60% of such insurance premium is borne by the company and 40% is deducted from salary of the employee.

My question is Can Employee claim deduction of such medical insurance premium deducted from his salary u/s 80-D. It will be useful if you give us legal judgments / pronouncements on your opinion.

Yes, for the fact that the mode of payment is any ,other than cash, and It is employee who paid for himself or his family’s insurance.

Get a certificate from the employer regarding deduction of amount for medical insurance purpose. You can claim to the extent the dedcution has been made by the employer for medical insurance subject to maximum RS 25,000
