Is family pension received by a widow taxable

    My uncle was working in the railways. He passed away while he was in service. My aunt has been receiving the family pension. There is no commutation in the pension. She is receiving a pension of about Rs35000 per month. Is this pension taxable. If so under what head the tax has to be deducted and also please let us know the form that has to be used for filling her returns. She does not have any other source of income.

    Family pension drawn by the widow is chargeable to tax under the head 'Income from other sources' However, a standard deduction is allowed @ 1/3rd of such pension or Rs 15000 whichever is less. ITR 1 may be used by the assessee to file the return of income.
