I am a working IT professional, staying in a home whose agreement contains 2 names as joint owners - my brother & mother, although entire payment was made by brother while buying the home. Brother's income is already taxable, whereas mother is house wife. So, is it allowed to pay rent only to my mother for staying in this house & consider the full rental income as mother's income while filing her IT return?

Thanks Neha for the quick reply.

From your statement "If your mother has substantial right including the right to receive rent", in my case do my brother need to transfer such rent receiving right explicitly in written form? Note that my brother has no issues if I pay entirely to my mother.

Yes, written consent is very important.

Is there any specific form or format available for this? Or just a paper having statement transferring corresponding right & duly signed by brother is enough?
