NRI receives notice from Income Tax for non-filing of ITR

    Dear Sir,

    I am a Non resident status since last 6 years and after that i stopped submitting IT return since my income is Tax free. Now i have got a notice from IT department questing why i am not filing my IT returns ?

    What should i do?
    Do i need to pay penaly ? if yes How much ?
    Shall i file now ? for how many years?

    Dear Rupesh

    I'm Karan Batra and I'm the founder of this website.

    As per law, it is not mandatory for you to file income tax return as your income is tax free. However, in certain cases - the income tax dept is sending notices to taxpayers for non-filing of income tax returns.

    You should reply to the income tax dept stating that you did not file income tax return as your income is tax free.

    To be on the safer side, you can start filing income tax returns from next year and mentioning in the ITR that your income is tax free and therefore Nil tax.

    Dear Mr Karan.

    IT raised Two queries and seeking response with in 20 day's.

    1) TDS 194 A for 2013-14
    2) CIB 403 Time deposit exceeds 200,000.00

    Please advise me what should I respond now.

    It means that you have FD income and tax is being deducted therefrom. This is their reason to believe that you might have taxable income.
    You mentioned that you do not have any taxable income.

    Greetings from Rupesh

    I would like to know, what happens to all amount lying in NRE FD or NRE account when I returned from Overseas employment to India, DO I need to pay tax of interest earned on FD, or is there any other ways to safeguard capital earned in NRE account.
