service tax for completed flat

    There are six units in flat building . All the flats are fully completed and is ready for occupation. The sale deed of UDS land & construction agreement are registered seperately, on the same date. Service tax is exempted for this case ?

    As the flats have already been completed, no Service Tax would be levied.

    Service Tax is only levied on under construction flats.
     
  3. Exemption is available only for Single Residential Unit used for own purpose.

    Exemption in respect of construction services provided for single residential unit is available even if part or full consideration is received before getting completion certificate. In other cases where whole consideration is received after getting completion certificate from competent authority then it amounts to sale.
    So no need to pay service tax.

    For full details refer sec 66E(b) of finance act, 1994 (Declared Services)
