Service Tax noticed received by a Contract Employee

    MYSELF IS A MERCHANT NAVY ENGINEER. I HAVE BEEN SERVED A NOTICE TO PAY SERVICE TAX FOR THE YEAR 2013-14. SINCE I BEEN A CONTRACT EMPLOYEE TO MY COMPANY AND THE COMPANY ITSELF IS PAYING THE SERVICE TAX TO THE GOVT, FOR THE SERVICE RENDERED BY THEM FOR OPERATING AND MAINTENECE OF THE SHIP. NONE OF OTHER EMPLOYEES IN MY COMPANY HAVE RECEIVED ANY SUCH NOTICE AS OF NOW. IS IT REQUIRED TO PAY THE SERVICE TAX

    Service Tax is liable to be paid by a Contract Employee if the total payment received during the year is Rs. 10 Lakhs.

    The Dept is correct in sending a Service Tax Notice to you and you should pay Service Tax to the govt on the services provided by you.

    Infact, all other Contract employees are also liable to pay service tax if the total value is more than Rs. 10 Lakhs.

    They may also soon get a service tax notice because as per Tax Laws, Service Tax is applicable and is liable to be paid in this case.
