Service Tax on Purchase of Flat

    Is service tax is legal if Flat is ready to move, means apartment/flat construction is over just finishing work is remaining and and possession time less than 3-4 month from agreement.
    If yes please advice at what percent and how to calculate it?
    If no is there any law for this?

    Irrespective of how much time is left for possession of the flat - if the flat is under-construction at the time of purchase/ registry of the flat - Service Tax would be levied.

    Builder already got CC but still asking for Service Tax and VAT. What is the correct legal position to argue with Builder. Negotiation is on to buy flat but not yet finalised due to this legal point.

    If the Completion Certificate has been awarded, then Service Tax is not applicable.
